This Invitation for Tenders follows the General Procurement Notice for this project which was updated in Procurement Opportunities on the European Bank for Reconstruction and Development website on 26th August 2008.

The Republic of Tajikistan has received a Loan from the European Bank of Reconstruction and Development (EBRD) towards the cost of a Road Maintenance Development Project and it is intended that part of the proceeds of this loan will be applied to eligible payments under the contract for which this Invitation for Tenders is issued.

The Ministry of Transport and Communications of the Republic of Tajikistan, hereinafter referred to as the Purchaser, now invites sealed Tenders from Bidders for the supply and delivery of the following equipment, spare parts and associated services.

Tenders are invited for one or more lots. Each lot must be priced separately.

Tendering for contracts to be financed with the proceeds of the loan from the Bank is open to firms from any country.

To be qualified for the award of a contract, Tenderers must satisfy the following minimum qualification criteria:

(a) in the case of a tenderer offering to supply goods under the Contract which the tenderer does not manufacture or otherwise produce, the tenderer has been duly authorised by the goods’ manufacturer or producer to supply the goods in the Purchaser’s country.

(b) the tenderer, including manufacturers of the goods and suppliers of the services, as appropriate, has the financial, technical and production capability and capacity necessary to perform the Contract.

(i) Tenderer shall provide a Certificate of Incorporation as a Company from the Registrar of Companies in the country where the company is registered. The certificate should be duly authorised by a Notary Public.
(ii) Tenderer shall provide Audited Balance Sheet and Profit and Loss Statements for the last two years showing the Annual turn over for each of those years to exceeds the value of the Tender submitted.
(iii) Tenderer shall provide Bank references showing availability of funds or credit to successfully perform the contract which shall be more than 10% of the Tender price. If deemed necessary the Purchaser may make enquiries to the Tenderers banker.
(iv) Tenderer shall provide a signed declaration, stating the tenderer has no outstanding or pending claims or litigation.
                                                                                                                  OR
Tenderer shall provide a list of all contracts over the last five years that have resulted in litigation or arbitration proceedings, with an indication of the matters and amounts in dispute, the parties involved and the resolution of the dispute.
(v) Tenderer shall provide a manufacturers signed declaration of Production and Quality Satisfaction for the equipment being offered, giving details of the number of years in production, number of units sold each year and customer satisfaction.


(c) the tenderer has satisfactorily supplied similar goods and services to other purchasers.


(i) Tenderer shall provide a signed declaration giving information on at least three (3) previous contracts as a prime contractor for the supply of similar equipment over the last two years, giving contract value, quantity and type of equipment delivered and name of Purchasers so that the Ministry of Transport and Communications of the Republic of Tajikistan may take up references if considered appropriate.
(ii) Tenderer shall provide letters of reference from past customers, including contact details so that the Purchaser may contact them if deemed necessary.


(d) the tenderer or its agent will be able to carry out the supplier’s maintenance, repair and spare parts stocking obligations:

(i) Tenderer shall provide a signed Certificate from the manufacturer concerned, stating that the tenderer is authorised to provide all necessary after sales support (commissioning, warranty services, training, service/repairs and spare parts stocking) in Tajikistan for the equipment being offered.

(ii) Tenderer must have service facilities or a Service Agent in the Republic of Tajikistan with facilities for repairing/servicing the supplied equipment, including availability of experienced staff, service equipment, sufficient stocks of spare parts, consumables and inventories to ensure correction of defects within 30 days upon receipt of a Purchasers claim. Therefore, the Tenderer shall provide a signed declaration giving details of their local agent who will be responsible for providing the after sales support (commissioning, warranty services, training, service/repair and spare parts stocking) in Tajikistan.

(iii) If such services or agents are currently not available in the Purchasers country, a Tenderer shall submit a signed declaration that it will be (if awarded the contract) represented by a qualified agent. If such a tender is accepted, documentary evidence on the appointment of a qualified agent shall be received by the Purchaser within (28) days from receipt of the notification of award by the Tenderer. Failure to submit such evidence shall be considered sufficient grounds for the annulment of the Contract Award. In this event, the Purchaser may award the contract to the next lowest evaluated Tenderer.

(iv) Where Tenderers are submitting Tenders for Lot 7 (Snow Blower) the Purchaser will consider Tenders from Suppliers that have dealerships or agents in neighbouring countries that are able to provide the necessary spare parts and service organisation. Therefore, the Tender conditions for Suppliers to have a dealership or service agent in Tajikistan will be waived for this Lot. The Tenderers must provide details of service facilities and agents in neighbouring countries who will deliver related services in accordance with the Contract conditions.

Tender documents may be obtained from the office at the address below upon payment of a non-refundable fee in the amount of US$200. If requested, the documents will be promptly dispatched by courier with no additional fees, but no liability can be accepted for loss or late delivery.

All tenders must be accompanied by a tender security in the currency of the tender or its equivalent in other freely convertible currency of not less than two percent of the Total Tender Price.

The Tender documents must be delivered to the address below on or before 13th October 2008 at 11:00am (Dushanbe time) at which time they will be opened in the presence of those tenderers’ representatives who wish to attend. The Tenders, which are received late, will be rejected and returned unopened.
